The process for appointment of authority and tribunal under Real Estate Regulatory Act (RERA) has received permission of election commission steering committee. Despite the EC clearance, appointments though continue to delay as the date to receive applications gets extended. Hundreds of property related issues and complaints thus will have to wait a little more for being tabled at the tribunal.
Rajasthan government had been unable to make these appointments every year past the act came in force at state. It was following orders of Rajasthan High Court that a three-member committee was recently constituted for conducting the appointments. As soon after the model code of conduct got implemented, the appointments became subject to election commission clearance.
According to officials, applications for the members have been invited upto November 15. The process is likely to be completed in January. The real estate act was constituted for the conservation of real estate buyers and homeowners. Registration under the act is now compulsory for all new real estate projects at state before advertising and booking. There are also provisions to ensure time-bound possession of the property to the buyers and compensation against the delay. A dedicated tribunal is proposed under the act to decide upon the related issues.
State government though had designated the Food Safety Tribunal as RERA tribunal as there were few cases under the act initially. The arrangement though got challenged at the HC and appointment of a permanent tribunal was ordered.
